У Менскім гарадскім судзе разглядаюць справу супраць праваабаронцы Насты Лойкі. Яе абвінавачваюць у распальванні варожасці да працаўнікоў міліцыі: нагодаю стаў нібыта ўдзел Насты ў напісанні справаздачы аб пераследзе анархісцкай супольнасці ў Беларусі за 2018 год, дзе сілавікам даецца крытычная ацэнка. За гэта ёй пагражае 12 гадоў зняволення. Сябры і паплечнікі перакананыя, што гэтая справа – асабістая помста з боку сілавікоў.

Праваабаронцу Насту Лойку затрымалі летась у кастрычніку. Наста магла з’ехаць ад пераследу, але да апошняга заставалася ў Беларусі. Яе затрымалі спачатку паводле адміністрацыйнага артыкулу, а пазней абвінавацілі ў распальванні варожасці.

«У нас ёсць перакананне, што гэта асабістая помста з боку ГУБАЗіКу за шматгадовую дзейнасць Насты Лойкі ў аспектах абароны правоў чалавека. Яна абараняла правы вельмі ўразлівых ці ненавісных рэжыму групаў насельніцтва – у прыватнасці, палітычных ці сацыяльных актывістаў і актывістак. Зняволеных, палітвязняў, людзей у міграцыі, уцекачоў і людзей з досведам бяздомнасці. І гэта асабістая помства за тое, што яна адна з найбольш выбітных праваабаронцаў не толькі ў Беларусі, але і ў свеце», – кажа Валдыс Фугаш, сузаснавальнік праваабарончай арганізацыі «Human Constanta».
Насту абвінавачваюць паводле арт. 130, ч. 3 КК («Распальванні расавай, нацыянальнай, рэлігійнай і сацыяльнай варажнечы»). Максімальнае пакаранне, паводле гэтага артыкулу, да 12 гадоў зняволення. Праваабаронцы адзначаюць, што часта суд агучвае максімальныя выракі. Гэта абумоўлена тым, кажа Валдыс Фугаш, што судовая сістэма, якая існуе ў Беларусі, цалкам падпарадкаваная вертыкалі ўлады. І яна выконвае палітычныя загады ў дачыненні любых людей, якія выяўляюць нязгоду з тым, што адбываецца.
А другое – гэта асабістая справа, калі супраць Насты такі гулец, як ГУБАЗіК, які замаўляе прысуд. І любыя працэдуры парушаюцца. Няма роўнасці бакоў, не ўлічваюцца ўсе фактары, ніякай сапраўднай кваліфікацыі справы няма.

«Мы чакаем прысуду і спадзяемся, што Наста будзе проста вызваленая з залы суда, бо гэта несправядлівае паседжанне. Аднак чакаем, што будзе», – кажа праваабаронца.

З патрабаваннем вызваліць Насту выступілі шмат якія міжнародныя арганізацыі. Але наколькі такія заявы, або ўвогуле рэакцыя міжнароднай супольнасці, уплываюць, залежыць у цэлым ад таго, наколькі працуе сістэма права ў той ці іншай краіне, адзначае суразмоўца «Белсату». І мы з вамі разумеем, што ў краіне, у якой нелькі тысячаў палітзняволеных, якія ўжо адбываюць тэрміны, а таксама яшчэ некалькі тысячаў палітычных справаў (пра якія мы не ведаем, бо пра іх не паведамляюць сваякі, бо баяцца, што гэта можа пагоршыць стан вязняў), шматлікія тысячы жорстка пераследуюцца, – ёсць пытанні з вяршэнствам права.

«Аднак, на маё перакананне, міжнародная салідарнасць неабходная. Трэба выкарыстоўваць усе агульнадаступныя і негвалтоўныя спосабы, каб дагрукацца да людзей, якія прымаюць рашэнні, што гэта несправядліва і няправільна. Мы мусім працягваць рабіць усё магчымае да таго моманту, пакуль усе несправядліва асуджаныя будуць вызваленыя і рэабілітаваныя. Я лічу, што ніхто не свабодны, пакуль кожны з нас не свабодны», – кажа Валдыс Фугаш.
Сузаснавальнік «Human Constanta» кажа, што Наста свядома прыняла рашэнне застацца ў Беларусі, бо яна любіць сваю краіну і людзей. Шмат гадоў яна рабіла магчымае і немагчымае, каб жыццё ў Беларусі было больш бяспечным і годным для максімальнай колькасці людзей, а не толькі для ўладных групаў або прывілеяваных асобаў. Яна адкрыта казала пра свае каштоўнасці, пра вяршэнства права, салідарнасць. Яна ніколі не рабіла чагосьці супраць Беларусі.
За гэта яе арыштавалі і катуюць. Валдыс Фугаш кажа, што за кратамі ў Насты распачаліся праблемы са здароўем праз жорсткае і бесчалавечнае абыходжанне і невыносныя ўмовы. Падтрыманне ў выглядзе бандэроляў, лістоў, паштовак салідарнасці можа ёй дапамагчы. Праваабаронца кажа, што Наста практыкавала і практыкуе ёгу, медытацыю, і магчыма, гэта ўдаецца ёй рабіць і цяпер. Салідарнасць унутры сістэмы таксама існуе, у камерах у тым ліку.
Трымацца ў зняволенні вельмі цяжка кожнаму, кажа праваабаронца. І такая актуальная сітуацыя для тысячаў людзей, якія застаюцца ў закладніках, а таксама для тысяч асобаў, чые блізкія і родныя ў няволі, яны таксама пакутуюць. І гэта скаардынавананая палітыка катаванняў з боку ўладаў Беларусі. Гэта злачынствы супраць чалавечнасці, якія апісваюцца і задакументаваныя ў міжнародных інсттытуцыях.
