The Supreme court has not answered the plaintiff’s claim. Andrey Belyakou, the owner of BELSATplus company, stated that television Belsat TV had been illegally using its trade mark and wanted the court to ban us from it.
A judging panel refused to uphold his claim having found it groundless.
‘As the plaintiff’s evidence failed to meet formal demands such verdict has been rendered. It might be appealed in the next three years. But what is of vital importance for us is that this case involving the same sides has already been out of Belarus’s court competence. It means that Mr Belyakou has no right to file the same lawsuit again,’ Mikhas Yanchuk, Belsat TV’s official representative in Belarus, said.
Mr Belyakou’s company sells satellite and cable TV equipment. In conformity with the law, one cannot block a trade mark if it is used in another field, i.e. in this case, broadcasting and production of TV programs). BELSATplus has not been engaged in the activities mentioned.
Our TV channel and its domain name were registered in Poland. As we do not broadcast from the territory of Belarus the trade mark does not fall within its jurisdiction. Furthermore, the channel is registered as Belsat TV; the registration name of the unitary enterprise is BELSATplus (certificate No 190991566).
